The canonization and placement of jurisprudential rules is on the hand of the Almighty as the creator of the creation and the Lord of men based on religious foundations, however there has been always a discussion among the Islamic scholars since the beginning of Islam on whether the right of canonization and placement of jurisprudential rules is also in the hand of the Holy Prophet (s.a.w) and the Infallible Imams as well or they were only in charge of preaching the rules and elucidation and no more? Using various narrations and other arguments some have considered such right for the Infallibles as well – while some of them consider such right only for the Holy Prophet (s.a.w) where others extend it to the Imams as well – while others rejects such theory based on logical arguments. In this paper in addition to description of both arguments, their theories have been summoned and the possibility of a verbal dispute has been increased meaning each side has taken over an aspect of the word Tashri’ (canonization) which will have great impacts on resolving such argument.
